New York Wages and Overtime Law

Many employees are entitled to overtime but they are unaware of the fact.  A majority of the time, employees sense that because they are on a salary they are not eligible to receive overtime.  The question is not if you are an employee on a paid salary, but if the employee is considered "exempt".  Although receiving a salary is one of the requirements for being exempt for receiving overtime, it is not the end of the quest.  The IT industry employees constantly are mistaken to be exempt from being paid overtime. While certain computer employees are exempt to receiving overtime, some are eligible to receive oertime pay.

The explanation may sound confusing so the best way to find out definitively is to contact an attorney with experience in overtime laws.  Overtime issues can be very complicated issues, but it has to be investigated as many employees are being denied overtime due to some companies not fully understanding the overtime laws.  failure to understand the law is not an excuse for a company. Penalties for violation or non-compliance include back pay for previous years the employee was not paid. Get assistance from a qualified attorney who specializes in wage and overtime law.
